Texas Department of Licensing and Regulation investigators perform inspections daily and find on the whole barbers across the state work hard to keep the citizens of Texas healthy and safe. However, that is not the case for the barbers who could have saved themselves from a violation and a fine by simply following the Barber Laws and Rules.
CREDO BLADES
Credo blades are dangerous and are never tolerated by TDLR. A barber in Donna, Texas, found this out the hard way when investigators found a Credo blade on the premises and issued a violation which resulted in a fine of $750.
Reminder: Barbers many not use razor-type callus shavers (Credo blades), Methyl Methacrylate Liquid Monomers, alum or other astringent sticks, fumigants (formaldehyde) tablets or liquids. Possession of any of these items on a licensed premise is a violation.
BOOTH RENTAL LICENSE
When leasing space to an independent contractor it is the responsibility of the shop owner to make sure the person has a valid booth rental license and operator’s license.
Barber shop owners in Greenville, Waco, Tyler, Plano and Granbury were cited for violations and fines assessed for leasing space to an individual who did not have a booth rental license. The administrative penalties ranged from $500 to $1000.
An independent contractor must have a valid booth rental license to operate in leased space. A shop owner and an independent contractor with no booth rental license in Fort Worth were fined $750 each.
Reminder: Shop owners must make sure independent contractors have a valid booth rental license and operator’s license to perform services in leased space.
Reminder: Independent contractors must obtain a booth rental license to perform barber services in leased space.
CLASS A BARBER LICENSE
Working without a Class A barber license or with an expired license is against the law. Five barbers in Dallas, Katy, Waco and Irving were working illegally and were cited for violations and fines totaling $4,350.
Six barbers in Austin, Houston, Waco and Deer Park were found operating with either no license or an expired license. Fines for the six barbers totaled $3,750. A barber shop must be licensed by TDLR in order to operate in compliance of the Texas Occupation Code.
Reminder: Barber shop permits must be renewed every two years. Make a habit of looking at your license and keep informed of the expiration date.
Reminder: Keep track of when your license expires. Approximately sixty days before your license expires you will receive a renewal notice from TDLR. Renew online http://www.license.state.tx.us/App_online or fill out the application and mail it to TDLR.
PROVIDE INFORMATION DURING INSPECTION
Barber schools are subject to the Barber Act and Rules just as barber licensees are. The Texas Administrative Code defines the rules barber schools must follow in order to maintain their standing as an approved school. One barber school didn’t cooperate during a TDLR inspection and was cited for not cooperating; just like barbers a school must provide the information requested by investigators during an inspection. The school received a $1000 penalty and was ordered to remain in compliance with all laws and rules administered by TDLR.
Reminder: TDLR investigators inspect your shop or school to help you stay in compliance with the laws and rules governing the barber industry. Working together we ensure your customers receive the high standard of service they have come to expect from the barber industry.
Save Money, Be In Compliance
The total dollar amount for the violations in this article was $14,500. These violations could easily have been avoided. TDLR encourages you to take a few minutes to review the Barber Laws and Rules book.
Reminder: Save your money! Stay in compliance with Barber Laws and Rules.
If you have any questions regarding licensing or the laws and rules please call TDLR’s Customer Service at (800) 803-9202 or (512) 463-6599 or e-mail your question to CS.Cosmetologists@license.state.tx.us.
Have you ever been sitting in shallow water of a Texas lake and had minnows nibble your feet? If the answer is “yes” you may have already experienced the newest pedicure craze to hit the United States. Customers of a Washington D.C. area nail salon are literally sticking their feet into tanks of tiny carp and letting the fish nibble away dead, flaky skin.
The Texas Department of Licensing and Regulation is conducting a review of the procedure referred to as “fish pedicures” in anticipation of the issue being raised by Texas nail salons. As you can imagine there are sanitation and health issues to consider before making a determination whether this newest fad meets Texas standards or not.
The owner of the D.C. shop stated he wanted something unique to replace the razor tool used by salons to scrape off dead skin on customers’ feet. In Texas Credo blades are illegal to use or possess in a salon and result in a violation being issued and a fine assessed.
TDLR will announce their findings on the fish pedicure soon. Until then please keep your minnow bucket in the closet.
Inquiring minds want to know. To find out more about the agreed orders and fines mentioned in the “Violations Are Easy to Avoid by Simply following Barber Laws / Rules” article visit the TDLR website at www.license.state.tx.us. On the barber web page there is a link to the releases containing detailed information.
Did you know final orders for violations are listed on the TDLR website? Go to the TDLR homepage, click on Search Violations by License Type, and you can view final orders against licensees and the violations.
Applying online for your barber or cosmetology renewal license is quick and easy. Go to www.license.state.tx.us/cosmet/cosmetforms.htm#onlinerenewals to renew your license. A license renewed online will usually be issued in a matter of days, rather than weeks.
Online renewal allows the fee to be paid with a credit card or a bank-issued Mastercard or Visa debit card.
