Facialists: Texas Cosmetology Rules Do Not Allow Medical Procedures
It is easy to get caught up in the excitement of a trade show; the up-beat music and colorful displays create energy to motivate you to visit booth after booth. You visit booths showcasing products you use daily. You also go to see booths exhibiting new products and equipment. A trade show is an exciting place for cosmetology professionals but the Texas Department of Licensing and Regulation (TDLR) cautions you to beware of making hasty purchases. Finding yourself the owner of a product or equipment that is not approved for use under your facialist license can dampen the enthusiasm you start your day with and put a dent in your wallet.
TDLR appreciates your goal to be an industry leader and acknowledges your hard work to offer new services. We also know trade shows provide an opportunity to learn more about new trends and see the equipment demonstrated but we urge you to review the Texas Cosmetology Rules to determine if the equipment or course you are considering provide services that can only be performed under the supervision of a medical doctor.
Texas law states a facialist can “beautify a person’s face, neck or arms using a cosmetic preparation, antiseptic, tonic, lotion, powder, oil, clay, cream or appliance.” Texas facialists may remove hair from a person’s body using depilatories or mechanical tweezers.
A facialist specialty license does not allow facialists to use lasers to:
These services must be provided under the supervision of a physician. The growing trend to provide these services in a “medispa,” a business where both medical and cosmetology services are offered is not prohibited but appropriate licenses must be obtained. The practice of cosmetology falls under the TDLR umbrella and the practice of medicine is in the jurisdiction of the Texas Medical Board.
TDLR encourages you to review the Rules before purchasing products that may have a medical application and make an informed purchase decision. The Texas Cosmetologists Laws and Rules book is available for purchase at the TDLR trade show booth or you may order your book by filling out the order form and mailing the form and your check to: TDLR, P.O. Box 12088, Austin, Texas 78711.
